This order represents the final stage ; n an un; Que and unprecedented
proceeding Drgi na l1y, this matter came to the Grievance Settlement
Board as a c1 ass i f.i cati on case. Subsequently, after several
adjournments, the parties agreed that the proceedings should be stayed
pending the issuance of a new or revised class standard for the positions
in question and the negotiations by the parties of an appropriate wage
rate to be assigned thereto When the parties found themselves unable to
agree upon this wage rate, they reached a further agreement under which,

inter alia, the matter of the wage rate was to be determi ned in an
-
interest arbitration under the auspi ces of the Ontar; 0 Pub 1 i c Servi ce
Labour Relations Tribunal and the question of retroactivity was ref€rred
back to the Gr i ev ance Set t 1 ement Board As such, we once again became
seized of an issue involving the original grievors herein, but this time
the issue did not relate to their classification grievances, but rather

to the degree of retroactivity, if any, which ought to be given to the i
increase that the Tribunal assigned to the new or revised class standard
After we heard evidence touching upon this issue, the parties reached the
following agreement, which we regard as a reasonable accommodation of the
interests of the Ministry and the Grievors
The part i es hereto agree that the terms here in sha 11 represent a
full and fi na 1 settlement of the issues ; n di spute

1 The employer shall pay to each of the gri evors here; n a sum
representing an increase of 8%. to the salary rates in effect on
the 15th day of October. 1984. and such rates negotiated
thereafter

2 In addition, the employer shall pay to the said grievors a sum
representing interest (at the Bank of Canada rate in effect on
May 1 . 1987) on that part of the monies referred to in
paragraph 1 t whi ch sha 11 have accrued commenci ng May 1, 1 987,
upto and including the date of payment

3 Thi 5 agreement sl1a 11 be without prejudice to the interests of
either party
