3 One day leave of absence with pay after every shift of
only two Correctional Officers (0645-1515 hrs )
The Toronto East Detention Centre lS a maximum security
holding centre containing offenders on remand or waiting transfer
to other institutions after sentence Unit 2A was referred to as
a segregation unit containing flve kinds of inmates who were
described as especially dangerous in relation to other inmates
These inmates are said to have committed various forms of
misconduct at the Detention Centre as defined in the Regulations
to the Ministry of Correctional Services Act, Regulation 645/88
section 28 (1)
Unit 2A consists of a long corridor with a row of ten cells
on either side of the corridor Each cell contains a single bed
with anywhere from one to three inmates per cell Generally two
Correctional Officers are scheduled to work during the morning

3 The observation and recording of inmate behaviour every 20
minutes
The Correctional Officers workIng in UnIt 2A are required to
clean the cells as well as the rest of the Unit during the
morning shift Two Correctional Officers are required to be
present !~en the cell doors are opened, and it was the position
of counsel for the Union that when the cell doors are opened the
two available staff cannot make the necessary observations WhlCh
are called for as part of the Job
The inmates are supposed to be in their cells at most times
They are, however removed from their ce 11 s for certain purposes
For example, Correctional Officers are reqUired to shower inmates
one at a tJ.me
The Correctional Officers assigned to Unit 2A are also
required to assist in transporting inmates to meetIngs with
lawyers, social workers and other professionals This involves
logging visitors in and taking the inmates to the interview room
and observing while the inmate is with the professional

that in addition to being assigned to Unit 2A more frequently

We were advised that the issue that would be raised was a
health and safety lssue based on the frequency of the Grievor's
assignment to Unit 2A and the allegedly insufficient number of
Correctional Officers assigned to that Unit
The position taken on behalf of the Grievor was that the
remedies sought were directly related to the alleged health and
safety risk
Counsel for the Grievor stated that it was her intention to
establish that the work environment within Unit 2A was more
stressful than that found in the other Units wi thin the Detention
Centre

Counsel for the Grievor stated that all of the items
requested for production were essential to establish the more
stressful environment within Unit 2A She argued that the
Summary of Workers' Compensation Board claims requested was

necessary to show that the injuries sustained by CorrectIonal

Officers in Unit 2A were significantly greater than those
suffered by Correctional Officers in the other Units This was
intended to establish the more dangerous and hence more
stressful, conditions prevai ling in Unit 2A
The second group of documents requested relating to the
Duty Roster sheets, were said to be necessary to establish that
the Grievor was scheduled to work in Unit 2A on a considerably
greater number of occasions than were other Correctional I

Officers and that he was transferred to Unit 2A more frequently

necessary in order to furnish a more exact picture of the
composition of the Unit which in turn, was intended to
demonstrate the potential for danger affecting CorrectIonal
Officers working there
The log books requested were intended to show the unusual

incidents that occurred during each shift in Unit 211. This was
intended to show the potential danger of working in Unit 2A and
the actual incidents involving injuries which were not serlOUS
enough to require the Correctional Officer to be off on Workers'
Compensation
Counsel for the Employer took the position that the
grievance was an individual grievance of a non-continuing natur~,
limited to a particular shift in time The statement of
grlevance does refer to a particular assignment however when
reading the grievance as a whole including the settlement
desired, it is evident that the grlevance is not so 1 imi ted and

refers to the alleged continuing violations of the Collectlve
Agreement as they affect the Grievor

With respect to the first Issue, the employer's counsel
submitted that the grievances were filed in January 1989
and, on their face, speak to the conditions WhICh existed In
January 1989 The employer's counsel submitted that as
article 27 of the collective agreement specifically r~quires
issues to be discussed within twenty days of an employee
first becoming aware of the. comp 1 a int and provides for a
further seven day period in which the parties try to resolve
matters before the grievances must be filed, the complaints
can only relate to those complaints existIng during that
time period Therefore he submitted that it is the
twenty-seven day period prior to the grievances being flIed
which is the relevant period to determine what documents are
to be produced
The employer's counsel submitted that the principles
under s 11 ( 11) of The Crown Employees' Collective
Bargaining Act, R S 0 1980, c 108 as amended which are to
be applied to summonses which are frequently referred to as
subpoenas duces tecum are similar to the princlples applied
under the Statutory Powers Procedure Act R S 0 1980,
c 484 in that the production of documents are to be
governed by their relevance and their admissibility for -
production in evidence and they are not to be used as a
form of discovery In support of its position the employer
relied upon the cases of Guru and Mcmaster (sic) University
Canadian Human Rights Reporter vol 2, Decision 50
paragraphs 2172 and 2193' Joseph an~ North York General
Hospital and College of Nurses of Ontario Canadian Human

The union's counsel submi.tted on the basis of the Eell
case (supra) that there is some scope for discovery in the

(Neil 0' Connell) and The Crown in Right of Ontario (Ministry
of Industry and Trade) G S B * 0772/85 (M K Saltman) that
it is not necessary to establish admissibility of the
documents in order to examine the documents
The union's counsel submitted that the appropriate test
to determin~the production of documents is whether the
documents are relevant to the issues to be heard and
'relevancy' IS to be liberally construed She submitted
that the time limits demand that the conditions exist at
that time, but they do not limit the scope of the evidence
that might be relevant to the issue Simllarly, neither the
number nor voluminosity of the documents prevents theIr
production if the documents are relevant
She submitted that the union is not on a fishing
expedition, but that the employees are unable to
particularize the documents as they are unaware of their
form She submitted that the nature of the summons 18
similar to a summons obtained in a competition grievance in
which all documents are sought to determlne the flaw in the
procedure In any event she was prepared to consider any
counter proposal which the Ministry may wish to make which
would particularize the documents in its possessIon
There was no dispute as to whether the board had
jurisdiction to order production of the documents the lssue
was only whether the documents referred to in the summons
ought to be produced
Before considering each document which is sought to be
produced it is necessary to consider the principles that
~ are to be applied to determine whether the documents are to
be produced
Although section 11(11) of the Crown Employees
Collective Bargaining Act empowers the board with the
jurisdiction to compel the production of written
documentation there is no discovery process provided in the
statute However, during the grievance procedure, a form of

Therefore, in determining what documents are to be
produced the board must apply a broad test of relevancy to
each document and consider whether each document is lIkely
to be relevant to the issues to be arbitrated As in the

(M K Saltman), this board finds that the test of relevancy
must be construed liberally
However. the ultimate decision on the relevance of
documents can only be determined after the documents have
been tendered in evidence The board can only determine the
weight that is to be attributed to the documents, during the
hearing, or upon hearing all the evidence and the
submissions of the parties
On the other hand although a liberal interpretation
must be applied to the determination of relevance the
summons is not to be sued as a 'fishing expeditlon' to seek
all documents that might possibly bear on the case nor is it
to be used to determine whether or not a party has a case
The purpose is to obtain evidence to support the party 5

'a subpoena should be broad enough to include some
measure of 'discovery' while being concerned that it

d'ocument is likely to be relevant The number of documents
that may be required 1S not a limiting factor if the test of

which are applicable under the Statutory Fowers Procedure
Act in the Human Rights Cases, but we cannot Section 12(4)
of the Crown Employees Collective Eargaining Act
specifically precludes the Statutory Powers Procedure Act
from applying and therefore it would be incorrect to apply
the criteria established in that act Furthermore, we
cannot apply the principles flowing from the statute by
analogy, as the Statutory Powers Procedure Act is quite

referred to above. we find that documents which are sought
to substantiate the conditions in January 1989 are prIma
facie relevant However, the tIme period set out in artIcle

At the same time. we find the search for any documents
over the one and one half years to two years before the
grievances were filed. is in the nature of a fIshing
expedition The union's counsel submitted to the board that
'she chose a one and one half year period as she was hopeful
that it was long enough to establish a trend , A party
cannot use a summons, which is broadly based to hope to find
the evidence to support a case On the information before
this board, it appears that the documents sought over such
an extensive period of time are not to substantiate a case
but rather to determine whether or not there is a case "
Unlike the Dowhev case, r am satisfied from the form of the
grlevance that it is a continuing one It was acknowledged by
counsel for the Employer that the matter had been raised by the
Grievor in the past with his Supervisor
After considering the principles referred to in the Dowhey
case . we find that the documents sought, which relate to a
continuing grievance. and which were created either before or
after the date of the grievance may be relevent to this case
The position taken by the Employer was that it had not changed

This case may be useful wpen this matter is considered on its

merits '-There- was an indication from Ms Galway that she wO\lld
have something more to say, at the hearing on the merits based
upon the jurisdiction of the Board to deal with the grievance as
other than an individual grievance. as it can be seen to request
relief for employees other than the Grievor Because the
documents sought can be viewed as necessary for the Grievor in
pursuit of an individual grievance , it was unnecessary to deal
with any other objection Should such an objection be raised at
the reconvening of the hearing, it will be addressed at that
time I did not believe that counsel for the Grievor was takIng
the position that we were being asked to issue an award that
would go beyond affording relief personal to the Grievor If this
is not the case we can hear argument on this issue as above
noted
The request for the documents sought is therefore allowed
