Gray Stacey Zafiriadis Grievance Officer Ontario Public Service Employees Union Len Hatzis Counsel Ministry of Government Services December 11, 2006. Union Employer Vice-Chair 2 Decision [1] The following disputes were referred to me for resolution under Appendix 32 of the parties' collective agreement: Disputes of Matthew Vezina, Nancy Salkali, Anna Hawryshuk, Irene Cvet and Maxine Phillips (Finch) Dispute of Kim Skyers (Oshawa) Dispute of Julie Phair (Owen Sound) Dispute of Elaine Futher (Kitchener) Dispute of Hanna Player (Stratford) Dispute of Barbara Ann Thompson (Brampton) Dispute of Susan Mills (361 University) [2] Each of these disputes raises an issue about the employer's calculation of the employee's Continuous Service Date upon her/his conversion to Flexible Part-Time status under Appendix 32. Having reviewed the facts, the language of Article 18.1(c) of the collective agreement and the parties' agreements and understandings concerning the application of that provision to employees with Flexible Part-Time status, the parties have advised me that they have no dispute concerning the employer's calculation of the Continuous Service Dates for any of these employees. [3] Accordingly, in so far as it raises an issue about the employer's calculation of her Continuous Service Date, the dispute of Susan Mills is dismissed. As the only issue raised by the other disputes listed in paragraph [1] concerned the employer's calculation of the disputants' Continuous Service Dates, those disputes are dismissed. Dated at Toronto this 20th day of December, 2006.
