DECISION
[1] The Parties will take all necessary steps to protect the confidentiality of the
information that comes into its possession from the Health Board Secretariat by
way of production in this hearing (the "Material").
[2] To the extent the Material contains personal identifying information and/or
medical information of individuals who are not party to this proceeding, that
information shall be redacted by the Employer prior to producing it to the Union.
The redacted Material shall be provided only to counsel for the Union who will
confine disclosure only to those individuals who need to know for purposes of the
hearing; and the Material shall not be published in any decisions of the Arbitrator.
Should there be any issues with the redactions counsel may address those
issues before the GSB. No copies may be made of the Material, except for
purposes of this hearing; and the Material may only be used for purposes of the
instant hearing.
[3] Any copies of the Material shall be returned to counsel for the Employer or
destroyed at the conclusion of the hearing except for copies retained by Union
and Employer counsel for their respective files and confidentiality shall be
maintained after the conclusion of these proceedings, save for the enforcement
of this order.
[4] This parties have consented to this order being issued without prejudice to any
position either party may take in this or any other matter, save for the
enforcement of this order.
