Decision
Having heard the submissions of the parties, the Board orders as follows:
1. The Board directs that, due to the pendency of related criminal proceedings, the hearing
dates previously scheduled in this matter be adjourned.
2. A Notice of Hearing setting forth new hearing dates will be issued.
3. The Union has agreed to provide to the Employer an OHIP consent form duly signed and
executed by the Grievor (in a form provided to the Union) within two weeks after this
issuance of this Decision.
4. The Union has agreed to provide to the Employer a consent form signed/executed by the
Grievor (in the form provided to the Union) relating to his family physician Dr. C.
Breyan, within two weeks after the issuance of this Decision.
5. The Union has agreed to provide to the Employer a consent form signed by the Grievor
(in the form provided to the Union) relating to his chiropractor Dr. Paul Vagners, within
two weeks after the issuance of this Decision.
6. The Employer has agreed to provide to the Union a full and unedited copy of the
Preliminary Review Report and the Report of the Investigation into Allegations of
Resident Abuse by Ian Dupuis, including witness statements.
7. The Employer has agreed to provide to the Union the information in its possession
regarding details of and the treatment of injuries to Residents 1 and 2.

8. The documents and information described above are to used solely for the purposes of
this litigation and may not otherwise be shared or distributed.
