HomeMy WebLinkAboutUnion 17-09-27IN THE MATTER OF AN ARBITRATION: BETWEEN: ONTARIO PUBLIC SERVICE EMPLOYEES UNION, LOCAL 415 (the Union) 1_101117 ALGONQUIN COLLEGE (the College) RE: Grievance Numbers: 2014-0415-0070 (Union Grievance 14A68) Appearing for the Union Appearing for the Employer: Sole Arbitrator: Hearing Held: Jane Letton, Counsel Jock Climie, Counsel Norm Jesin September 27,.2017 AWARD In this case the parties seek a determination as to whether I should grant any relief pursuant to Article 2 of the collective agreement in two cost centres -- 581 Q (Hairstyling) and 581C (Culinary Management and Cook Training). Article 2 requires the College to give preference to full time employees over partial load and/or sessional employees, subject to operational requirements. Having regard to the representations of the parties, it is my determination, based on the unique circumstances of this case that exist at this time, that the College is directed to establish two additional full time positions in cost centre 581Q (one to start in Winter 2018 and the other in Fall 2018) and one additional full time position in cost centre 581C (to start in Fall 2018). It is further my determination that any remaining hours beyond those filled by full time employees or to be filled by the new full time positions, are properly staffed by the College in accordance with its operational requirements. Any dispute between the parties over the classification of the full time positions established by this Order may be dealt with by a fresh grievance. Subject to the foregoing, I remain seized to deal with any difficulties that the parties may have in the implementation of this award.
