DECISION
[1] This matter was scheduled to convene on April 18, 2018. On that date, I was
advised that the Employer will be making a motion to consolidate the grievances
of Brian MacDonald with the grievances that are already before me. Mr.
MacDonald is represented by counsel, Mike Biliski, who was not available to
attend today’s hearing.
[2] Accordingly, we used this date to address certain case management issues. On
the basis of those discussions, I order the following:
1. The Employer is ordered to produce to the Union the CSOI Investigation
Report in respect of the Grievors’ complaints.
2. The Employer’s motion to consolidate the grievances of Mr. MacDonald
with the current proceedings will be heard on June 26, 2018 (subject to
confirmation of availability from Mr. Biliski).
3. There was some discussion that there may be a motion to stay the current
proceedings pending completion of Mr. MacDonald’s criminal trial. If such
a motion is to be brought, it will also be heard on June 26, 2018.
4. The parties are to engage in discussions about other potential preliminary
issues, including how to address additional grievances filed by the
Grievors in the last year. If the parties are unable to reach a resolution in
that respect, I will consider how to address those issues after the
determination on the motion to consolidate.
