DECISION
[1] Having heard the submissions of counsel, I make the following Order for
Production:
The Union is to provide the following by close of business on Friday, April 20,
2018:
Requests for Particulars – Generally
1. All material facts on which the Union relies in OPSEU File No. 2016-5109-
0011
2. Particulars regarding alleged disabilities
3. Particulars regarding alleged need for accommodation, including need for
assistive animal
4. Particulars regarding alleged damage to/loss of hearing aids
5. Particulars regarding LCBO’s alleged failure to accommodate
6. Particulars regarding efforts to train Saphire as an assistive animal
7. Particulars regarding allegations that Chris Remdeyall intentionally hurt
the Grievor’s hearing via siren testing.
[2] The Union is to provide the following as soon as possible:
Requests for Documents – Generally
1. Medical records from treating physicians pertaining to the Grievor’s
diabetes and hearing impairment, including: Dr. Crummey, Dr. Holler, Dr.
Schomber, Dr. Grossman, Melissa Reekie, any ENT specialists,
Audiologists, etc.
2. All records regarding efforts to have Saphire trained and certified as an
Assistive Animal to attend at work with the Grievor, and alert the Grievor
regarding his insulin pump, including but not necessarily limited to: training
records, certificates, qualifications, invoices, receipts, and
correspondences.

3. All records regarding alleged damage to/loss of hearing aids, including
hearing aid inspection (and determinations of damage), repair, and
replacement.
