Decision
Based on the agreement of the parties I hereby declare and direct the following:
1. The employer is to produce to the union notes taken by the District Manager in
respect of its investigation of the grievor, statements taken from individual employees
in connection with the investigation of the grievor, whether or not those persons will
be called as witnesses, and other relevant documentation relating to the investigation
of the grievor, the grounds for imposition of discipline and/or any documents relied
upon by the employer with respect to the penalty imposed upon the grievor;
2. The production of the above documents by the employer to the union is on the
following basis:
(a) The documents disclosed, and the information contained therein, are to be
used by the union and the grievor in connection with this proceeding and for
no other purpose;
(b) The grievor shall not contact nor attempt to contact persons whose identities
are known to him from the contents of these documents;
(c) Counsel may review the contents of the documentation with the grievor and
the Union but shall not provide the grievor with copies of the documentation;
(d) The information contained in the documentation shall be kept confidential,
save and except as necessary for the purposes of this proceeding; and
(e) The Board has full power to enforce the terms of this order.
