Decision
The parties have agreed to an Expedited Mediation-Arbitration Protocol. It is not necessary to
reproduce the entire Protocol here. Suffice it to say that the parties have agreed to a ?True
Mediation-Arbitration? process, wherein each provides the Vice-Chair with submissions, which
include the facts and authorities each relies upon. This decision is issued in accordance with the
Protocol and with Article 22.16 of the collective agreement, and is without prejudice or
precedent.
The grievor suffered an injury at work on November 9, 2003, when he was attacked by an
inmate. The grievor has missed considerable working time since the incident and is still coping
with his injuries.
After reviewing the submissions of the parties and the collective agreement, I order as follows:
1. The grievor?s CSD shall be adjusted in accordance with the outcome or decision arising
from the reconvening of the Lucan matter 2003-0167 etc., being heard by Vice-Chair
Abramsky
2. The grievor?s rate of pay shall be adjusted to the top CO2 rate effective January 1, 2008,
and WSIB will be notified accordingly.
3. The grievor shall receive the sum of $5000 as compensation.
