Leighton FOR THE UNION Scott Andrews Grievance Officer Ontario Public Service Employees Union FOR THE EMPLOYER Brian Scott Staff Relations Officer Ministry of Community Safety and Correctional Services HEARING July 7, 2008. 2 Decision Ms. Wendy Goring has sixty-eight grievances before the board. Eight of those are competition grievances. Of the competition grievances, the union and the grievor have decided to focus on what the grievor considers to be the most egregious. At the outset of the hearing scheduled for mediation-arbitration, pursuant to Article 22.16 of the collective agreement between the parties, the union requested the production of documents for two of the competitions being grieved by Ms. Goring. The first is for a permanent Probation and Parole Officer in Oakville, the second for a position in Don Mills. The employer had concerns about the privacy of the applicants in these competitions. I made an order at the hearing as follows: The documents produced by the employer on July 7, 2008 of the Oakville competition file, with the names of the applicants redacted, and any and all further documents forwarded to the union with regard to Ms. Goring?s grievances, made pursuant to the disclosure request by the union shall not be used for any other purpose and only for this grievance. The parties also agreed to an expedited hearing process with regard to the grievances before me, which is now hereby ordered by the board: 1.The employer shall forward the documents for the Don Mills competition (June 2007) to the union with the names of the applicants redacted, by July 21,2008; 2.The union has until July 28, 2008 to inform the employer if documents are missing; 3.The employer has five working days to respond to any additional request for documents by the union; 4.The union shall forward its written submissions and any case law that it relies on to the board by 5 pm on August 11, 2008. 5.The employer shall forward its written submission and any case law that it relies on to the board by 5 pm on September 8, 2008. 3 6.Should any issues arise between the parties regarding the time limits noted above, the board should be notified immediately, and the problem shall be heard by conference call. 7.Upon receipt of the parties? submissions, the board shall issue a written decision. th Dated at Toronto this 8 day of July, 2008.
