HomeMy WebLinkAboutMaurice 12-12-12AWARD In December 2011, the Municipal Property Assessment Corporation ("MPAC") held a Competition (MPAC-216-11) for a PA4 Property Valuation Analyst, A number of employees applied for the position, Including -jean -Paul Maurice, Rejean raubert and Ron Pettifer. Mr, i:auhert was the senior candidate, followed by Mr, Maurice, Mr. Maurice tiled a grievance, dated March 6, 2012, claiming that he was improperly denied the position, The parties proceeded to arbitration and a number of hearing dates were held. After having heard representations by the parties, as well as having reviewed numerous documents and hearing some evidence, i made a recommendation for settlement of the grievance. The parties accepted my recommendation and agreed that I order the following. 1. This Order will have no precedential value, 2. The Employer shall re -run the competition. The candidates who may participate In the re -run are restricted to Mr. Pettifer, Mr, Maurice and Mr, nauhert, should they elect to so participate, 3. The re -run shall consistof an Interview and a written test, as well as, consideration of the candidates'resumes, past work histories, written performance appraisals and references identified by the candidates, 4. The Interview Panel shall consist of Bert Moline, Sylvain St.Denis and a representative from the Human Resources Department. r. The Competition shall be held within sixty (60) days of this Order. 6. The Employer shall assign a score value to past work h#storles and the reference check results. 7, 1 shall remain seized of any disputes or grievances that arise out of the re -run competi tion. 6, Should the above steps be followed, the Parties acknowledge that better of Understanding #8 of the Collective Agreement will have been complied with; DATED this December 12, 2012 Susan Tacon, Sole Arbitrator,
