Decision
This is a discharge grievance filed by OPSEU on behalf of Phil Bannister. His employment as a
seasonal employee in the LCBO?s Durham Warehouse was terminated by letter dated June 11,
2007 as a result of his ?ongoing and unauthorized absence?, his failure to provide medical
documents and his past disciplinary record.
The union was unsuccessful in its efforts to contact the grievor prior to the hearing which was
scheduled for July 24, 2008. He failed to attend, and the union sought an adjournment. The
employer was advised of the request well before the hearing. It opposed the request at the
hearing. Neither party took steps to serve the grievor with the Notice of the Hearing. This is the
first request for an adjournment.
Having heard the submissions of the parties it is hereby ordered that this matter is adjourned to
be heard in Oshawa on September 19, 2008. The adjournment is on a peremptory basis. That is,
the hearing will commence on that date.
