DECISION OF THE BOARD; May 12,2005 I. This is an application under section 96 of the Labour Relations Act, 1995 (the "Act") which allcges a violation of section 74 of the Act. 2. By letter datcd February 24, 2005, counsel for the responding party requested particulars of the application as follows: 1. Specifics and particulars of when the Applicant approached the Union, who the Applicant approached and what the Applicant wished the Union to do and did not do. 2. What, if anything, was wrong with the representation that was provided by the Union to the Applicant 3. How any of this constitutes arbitrary, discriminatory or bad faith representation on the pmt of the Union. 4. Copies of any correspondence from the Applicant or her "representative" with respect to requests made by the Applicant to the Union to file personal or policy grievances on her beha If 5. Copies of any correspondence or particulars where the Applicant has filed a complaint against anyone under the OPSEU internal discrimination and harassment policy. 3. By Decision dated March 9, 2005, the Board gave the applicant 10 days to respond to the union's request. The applicant sent correspondence in response. However, the applicant did not respond to the responding party's request, but simply made additional allegations. 4. Thc Board agrees with the union that the application is difficult to understand and is not adequately particularized. Under the circumstances, early disclosure would be beneficial.
