This case involved an issue of whether or not the grievor's position was in the bargaining
ullit. Further to the submissions of the parties and with their agreement, I hereby issue
the following award:
1. Effective October 20, 2008, the grievor shall be accommodated in a full-time
position as a Patient Care Unit Clerk in Psychiatric Rehabilitation A (PRA).
The grievor shall be accommodated in this position pursuant to article 34.07
of the collective agreement ~ subject to his successfully completing a ninety
calendar day probationary period. The grievor's current wage rate and
placement on the grade shall remain the same. Failing his successful
completion of the probationary period, the grievor shall be accommodated
within another comparable position at the Centre. The grievor shall remain in
the PCU Clerk position pending the need to complete any subsequent
accommodation process.
2. The Clerk 2 (Finance Department Cashier). also known as the Cashier and
Patient Trust Accotmt Clerk, is a position that is excluded from the bargaining
unit pursuant to Article 2.02 of the collective agreement.
3. The grievances dated JW1e 23,2008 concerning the status of the above noted
finance cashier position are resolved and as such, the union has withdrawn
them.
4. As a result of the grievor having been accommodated in the above noted
position pursuant to Article 34.07, the union shall not process any grievances
related to Competition # 247-08.
5. Barry Fisher shall remain seized in respect of the implementation oftbis
award.

Whereas the parties wish to resolve all matters in dispute in respect of tvvo grievances
respecting the status of the frnance cashier position (fonnerly the Cashier and Patient
Trust Account Clerk position), the parties agree to the following being set out in a
consent award of Arbitrator Barry Fisher.
I. Effective October 20, 2008, the grievor shall be accommodated in a full-time
position as a Patient Care Unit Clerk in Psychiatric Rehabilitation A (PRA). The
grievor shall be acconunodated in this position pursuant to article "34.07 of the
collective agreement * subject to his successfully completing a ninety calendar
