Decision
[1]The Union and the Employer agree to a consent order made without precedent or
prejudice and not to be relied on in any other proceeding, that:
(a)The grievor will not communicate in any fashion, (including but not
limited to written correspondence, e-mails, telephone calls, faxes), with
employees of the Ministry of Education, Ministry of Training, Colleges
and Universities, Ministry of Government Services and the Community
Service Cluster which services the Ministry of Education and Ministry of
Training, Colleges and Universities with respect to matters arising out of
the grievances before this Board.
(b)This order does not prevent the grievor from communicating with Union
officials who may be employees.
(c)This order does not prevent the grievor from communicating with respect
to matters arising out of this grievance before this Board with friends who
may be employees of the Ministry of Education, Ministry of Training,
Colleges and Universities, Ministry of Government Services and the
Community Service Cluster which services the Ministry of Education and
Ministry of Training, Colleges and Universities, but such communication
shall not be in the workplace.
(d)The grievor will not communicate directly with the Arbitrator in this
matter.
(e)Any breach of the Board?s order will result in the dismissal of all
grievances presently before the Board.
(f)For greater certainty this order in no way derogates from any previous
order of the Board in these matters.
