The Board will forthwith contact the parties to identify an alternative hearing date to be set for January, 2020 or as soon thereafter. 3) The parties have agreed to work towards completing an ‘Agreed Statement of Fact’. 4) Counsel for the Employer shall complete a draft of the Agreed Statement of Fact and forward it to Counsel for the Complainant and the Board by no later than November 22, 2019. Should Counsel require additional time to complete the Employer’s draft the Board requests that Counsel advise the Board of the need for an extension of time at the earliest possible opportunity. 5) The Board shall schedule a conference call with the parties during the week of November 25th and 29th, 2019, or alternatively, December 2nd and 6th, 2019. The purpose of the teleconference shall be to determine the status of the Agreed Statement of Fact and any other procedural matter or matters that involve the complaint. 6) Counsel for the Complainant shall complete his response to the draft agreed statement of fact by no later than Friday, December 13, 2019. Should Counsel require additional time to complete his response to the draft he shall notify the Board at the first opportunity. 7) If the parties are able to successfully conclude an Agreed Statement of Fact the Board will the establish a process by which written submissions and argument will be forwarded to the Board by the parties or, in the alternative, direct that the parties to attend at the Board in January, 2020, to provide submissions and or final argument. 8) However, should the parties be unable to complete the Agreed Statement of Fact the hearing of this matter will resume on the hearing date set for January, 2020.
