Decision
[1]The Employer and the Union at the Toronto West Detention Centre agreed to participate
in the Expedited Mediation-Arbitration process in accordance with the negotiated
Protocol. Many grievances were settled through that process. However, a few remained
unresolved and therefore require a decision from this Board. The Protocol provides that
decisions will be issued within a relatively short period of time after the actual mediation
sessions and will be without reasons. Further, the decision is to be without prejudice and
precedent.
[2]Rob Edwards filed a grievance alleging various violations of the collective agreement
flowing from his treatment under the Attendance Support Program.
[3]After hearing the facts and submissions of the parties I am of the view that the grievor
must provide more information to the Employer in order for the Employer to properly
consider this matter.
[4]If that information is provided, the Employer will, as it should in all circumstances,
review the individual facts and assess the merits of Mr. Edwards? claim.
[5]Hopefully, the parties will be able to resolve the issues between them. However, I remain
seized in the event that any issue remains outstanding at the conclusion of that process.
