Decision
[1]The Employer and the Union agreed to participate in the Expedited Mediation-
Arbitration process in accordance with the negotiated Protocol for various grievances
filed by Bailiffs. A number of grievances were settled through that process. However, a
few remained unresolved and therefore require a decision from this Board. The Protocol
provides that decisions will be issued within a relatively short period of time after the
actual mediation sessions and will be without reasons. Further, the decision is to be
without prejudice and precedent.
[2]Mr. Patrick Hamel is a Correctional Officer who filed a grievance alleging that various
provisions of the collective agreement were violated regarding a job competition.
[3]In preparation for our med/arb session of June 11 and 12 of 2008, the Union wrote to the
grievor in May requesting particulars in this matter.
[4]At that session the grievor had not responded and I allowed a deferral of the matter until
this session.
[5]The Union again wrote to the grievor, at the address currently on file with the Employer,
on August 18, 2008 asking for the facts surrounding his grievance.
[6]In response to my inquiries, the Union informed me that as of January, 20, 2009, it had
received no information from the grievor in this regard.
[7]Accordingly, I dismiss the grievance.
