Briggs FOR THE UNION Jackie Crawford Grievance Officer Ontario Public Service Employees Union FOR THE EMPLOYER Nicholas Sapp Employee Relations Advisor Ministry of Children and Youth Services HEARING March 19, 2009. 2 Decision [1]A hearing was held to deal with a number of grievances filed by Ms. Wendy Knaap. One grievance was resolved in a Memorandum of Settlement between the parties. [2]Ms. Knaap filed two grievances regarding issues flowing from the last legal strike in 2002. One of the grievances was regarding payment of statutory holiday pay. It was the Employer?s view that the grievor had been properly compensated in accordance with the decision of Vice Chair Brown issued shortly after the strike. The Union has requested proof of that payment. The Employer agreed that it would provide this information to the Union and it was hoped that this could be achieved within approximately one week of our hearing. [3]There was another grievance that alleged the Employer failed to pay for Essential Services worked. This grievance may or may not have been disposed of at the same time as others shortly after the strike. Mr. Gledhill, of the Ministry of Community Safety and Correctional Services will make inquiries to see if this grievance has been determined and, within two weeks he will notify both Ms. Jackie Crawford of the Union and Mr. Nicholas Sapp of the Child and Youth Services Ministry of his findings. If there was a Board order to pay monies to the grievor regarding this second grievance Mr. Sapp will then determine if those monies were pay and will so notify Ms. Crawford.
