The documents had been produced to the Union in advance of the hearing. However, they had been ?redacted? to excise certain portions the employer was concerned about distributing any more widely than required. [2]After hearing the submissions of the parties and having regard to their agreement, I directed the Employer to provide the Union with unedited copies of the documents in question. [3]The documents are to be provided to Union counsel, who may review them with his advisor. The documents are not, however, to be circulated by the union beyond those two individuals. The documents are to be used by the union solely for the purposes of these proceedings. [4]This ruling applies to all of the documents produced by the Employer save and except those documents which the parties referred to as relating to the ?RBP?s. The Union?s copies of these documents will, at least for the interim, remain redacted. Should there be any issues relating to those documents, including whether unedited copies ought to be provided to the Union, the matter may be addressed at or prior to the next day of hearing. th Dated at Toronto this 5 day of May 2009.
