Brown FOR THE UNION Mr. Stephen Giles Grievance Officer Ontario Public Service Employees Union FOR THE EMPLOYER Peter Dailleboust Counsel Ministry of Government Services HEARING May 11, 2009 - 2 - Decision Alla Herzan filed two grievances alleging discrimination on the basis of [1] family status. As the parties agreed the matter would be heard under article 22.16 of the collective agreement, this order is issued without prejudice and precedent. Based upon the formal presentations of the parties and informal discussions with them, I direct that the grievor be accommodated in the following manner: 1.Alla Herzan is granted an extension of unpaid leave for the period from May 18, 2009 to May 17, 2010; and 2.Work performed by any employee appointed to replace the grievor during her unpaid leave shall not count for the purpose of conversion under article 31A of the collective agreement. th Dated at Toronto, this 20 day of May 2009.
