DECISION
[1] This matter came on for a hearing on March 30, 2021 at Toronto. Having heard
the submissions of the parties, the Board hereby orders as follows:
i) Witnesses are excluded from the hearing until such time as it is necessary
for them to give their evidence;
ii) Any and all documents produced by the parties will only be used for the
purposes of this litigation;
i) The Board shall provide interpretation in the American Sign Language at
the hearing to such extent and in such form as the Board deems to be
appropriate;
ii) Any documents produced for use in these proceedings by either party
shall only be viewed by the parties’ counsel and the persons who are
instructing them in this arbitration or who are called as witnesses in this
arbitration. A copy of the documents is to be provided by the Board to the
translation agency providing the translators for transmittal by the agency
to the interpreters to be in attendance at the hearing for the purpose of
aiding translation at the hearing. The grievor may receive a copy of any
such documents. Any such documents are to be held in strict confidence
with no other disclosure of the information to any other individual;
iii) There shall be no other photocopying of these documents, except as may
be required to produce copies of a potential exhibit(s) for the hearing and
the document shall otherwise remain in the possession of counsel;
iv) Anyone provided with a copy of any such documents, is to be provided
with a copy of this order and are to return their copy to counsel at the
conclusion of this proceeding;
[2] The hearing will resume on Thursday, April 1, 2021 at which time the hearing will
commence with the parties’ opening statements.
