HEARINGJune 23, 2009.
Decision
[1]This decision is in partial resolution of Mr. Pacheco?s grievances.
[2]As a permanent accommodation, the Grievor is to be transferred from his current
position to that of a provincial bailiff (?the bailiff position?).
[3]The bailiff position will become the Grievor?s home position upon him
commencing his duties in that position.
[4]Upon production of a medical certificate confirming that the Grievor is physically
fit to assume the duties of the bailiff position, the Grievor will be transferred to
the bailiff position.
[5]Prior to the transfer, the Grievor will obtain the requisite driving license to drive
the vehicles operated by the bailiffs. Upon the Grievor obtaining the license, the
reasonable costs of obtaining it will be borne by the Ministry.
[6]I remain seized with respect to the implementation of this decision, and the further
issues in the grievances.
