DECISION
[1]During a conference call on August 19, 2009, I entertained submissions from counsel on
the Union?s request to adjourn the hearing date of August 21, 2009, sine die. In the alternative,
Union counsel recognized that I had the power to adjourn the hearing and set the matter down for
hearing on a subsequent date. Employer counsel vigorously opposed simply adjourning the
hearing, and argued that I should direct the parties to complete this matter by written
submissions. During his submissions, Employer counsel referred to some decisions and
documents, and he subsequently sent them to me in an email. I have reviewed this material
during my deliberations. Given the timing, I advised counsel that I would try to provide the
parties with a bottom line decision no later than noon on August 20, 2009.
[2]After considering the basis for the Union?s request and the submissions of counsel, I will
grant the Union?s adjournment request, but not on a sine die basis. Accordingly, the hearing
scheduled for August 21, 2009, is adjourned and this matter will continue on Friday, November
13, 2009. The reasons for this decision will soon follow. In my reasons, I will set out what
issues will be addressed at the November hearing.
