(the “Employer”) -and- Ontario Public Service Employees Union, and its Local 281 (the “Union”) Re: Grievances of R. Crosby-Thompson DECISION ARBITRATOR: Daniel P. Randazzo, Arbitrator APPEARANCES: Union: Ed Holmes, Counsel Employer: Matthew Badrov, Counsel Ashley Mulrooney, Counsel DATE OF HEARING: December 20, 2021 DATE OF DECISION: December 20, 2021 1. These matters come to me by way of consensual appointment. The grievances concern the suspension and ultimate termination of Grievor. These matters were scheduled for hearing on December 20, 2021. 2. On December 20, 2021, despite having notice of the hearing date, the Grievor failed to attend. The hearing was adjourned from 10:00 A.M. to 11:00 A.M. to allow the Union to contact the Grievor to ascertain whether or not she intended to and/or was able to attend. Despite best efforts, they did not make contact with the Grievor. 2 3. Given the Grievor’s failure to attend, the hearing was adjourned and re-scheduled for January 6, 2022. After hearing from the parties, I have made the following directions with respect to the rescheduling of these matters: i. The matter will be rescheduled as a videoconference hearing on January 6, 2022, commencing at 10:00 a.m. A Notice of Hearing will be sent to the parties. ii. The Union, through its counsel, is directed to communicate with the Grievor to ascertain the reason or reasons for her non-attendance on December 20, 2021, and to confirm her attendance on January 6, 2022. iii. The Union will, no later than January 3, 2022, advise counsel for the Employer, and my office, with respect to the Grievor’s attendance on January 6, 2022.
