Decision
[1]There are two Union grievances before me which allege that the Ministry of
the Attorney has contravened the Collective Agreement ?by allowing non-ministry
employees to perform bargaining unit work in the Victim/Witness Program?. The
grievance dated April 2, 2009 relates to the Sudbury Region and the one dated June 8,
2009, pertains to Thunder Bay.
[2] Having regard to the agreement of the parties at the hearing at Toronto on
May 4, 2010, I hereby make the following order:
(1) The Employer is ordered to produce all arguably relevant documentation
concerning this matter to Union counsel not later than June 30, 2010. The
parties may agree on consent to extend this deadline.
(2)The material produced, including any confidential material, is to be used only
for purposes related to this proceeding.
(3)The parties are to continue to confer with respect to determining the
categories of documents which are arguably relevant for production. Any
issue concerning the production of particular documents or categories of
documents, including any question of privilege, will be dealt with by
teleconference by Vice Chair Ken Petryshen if the parties are unable to agree.
th
Dated at Toronto this 5 day of May 2010.
