Decision
[1] This matter is a grievance filed by the Ontario Public Service Employees Union
(the “Union”) on behalf of Kate Clark Adams (the “grievor”) on August 13, 2021.
[2] This matter was scheduled for hearing on January 12, 2023. On that date the
parties engaged in efforts to resolve the grievance. When those efforts failed, this
matter was scheduled for hearing on July 7 and August 29, 2023.
[3] On July 6, 2023, at approximately 10:39 p.m., the grievor advised the Union that
she would not attend the hearing on July 7, 2023.
[4] The Employer was advised of the reasons provided by the grievor to the Union for
her non-attendance on the morning of July 7, 2023. The Employer requested that
this matter be dealt with in the usual fashion with the grievor being directed by the
Board to state her reasons for not attending and providing the Employer with the
opportunity, should it not be satisfied with the reasons provided, to seek to have
the grievance dismissed.
[5] Accordingly, the grievor is hereby ordered to provide to the Union the reasons for
her absence from today’s hearing no later than August 4, 2023, failing which this
matter will be deemed to be dismissed.
[6] In the even the grievor provides the Union with reasons for her absence, such
reasons are to be provided to counsel for the Employer who will then advise the
Grievance Settlement Board, no later than August 18, 2023, whether the Employer
is satisfied with the reasons and agrees to the relisting of this matter or is not
satisfied with the reasons and seeks to have the matter dismissed.
[7] The hearing date of August 29, 2023 is hereby cancelled and this matter is
adjourned sine die
