Decision
[1] I have before me four individual grievances filed by four Correctional Officers
challenging the discipline issued to them for events that occurred at the Central East Correctional
Centre.
[2] Having regard to the agreement of the parties, the Board hereby directs as follows:
1. The Employer is directed to produce to the Union copies of all documents
upon which it intends to rely in these proceedings.
2. To the extent that there are any further documents in the employer’s procession
which are arguably relevant to the matters in issue in this case, the Employer is
directed to provide Union counsel with a list of any such documents and any disputes
regarding the production of such documents may be taken up with the Board.
3. The production of any documents under the terms of this order is subject to the
following conditions:
(a) The documents produced are to be used only for the purposes of this matter
and are not to be used for any other purpose or matter.
(b) The documents produced are to remain in the procession of Union counsel
and, subject to the immediate needs of the instant matter, are not to be shared,
copied or otherwise distributed.
(c) The documents produced are to be returned to the Employer at the conclusion
of the litigation of this matter.
Dated at Toronto this 13th day of July 2012.
