Hearing

Suite 405, 77 Bloor Street West

In the grievance he filed with this Board, Mr. G.
Andrews complained that he was, as an Agricultural Technician 2,
improperly classified, Succinctly, it was Mr. Andrew's position
that in his position as "Technician in charge of Dairy Cattle"
at the Ridgetown College of Agricultural Technology, which
operates under this Ministry's Research and Education Services
Division, he performed the functions of an Agricultural
Technician 3.
After receiving and listening to the evidence adduced
by the parties, and after entertaining their arguments
following therefrom, this Board recessed the proceedings,
and after further deliberations, reconvened the hearing to
advise the parties orally of the fact of and reasons for our
decision, At the outset, we advised the parties that where,
as here, a grievance did not raise any substantial issue of
principle, did not have any precedential value to the parties,
and where this Board intended to simply apply settled criteria
and reasoning articulated in earlier awards, it was, and until
persuaded otherwise, will remain our practice, which is followed
daily in our courts of criminal and civil jurisdiction, to
issue oral awards at the conclusion of the hearing.
So advised, and relying on the criteria we have
earlier set out in Re Rounding et al 18/75;Re Vukoje 13/?5
and Re: !zhompson 7/76, this Board informed the parties that

on the evidence adduced, which was not in serious dispute
between them, and agaip5.l. t/it, Class Standards for the
position in question, that Mr. Andrews is, in his present
duties, in our opinion properly classified as an Agricultural
Technician 2. In the result and for the reasons outlined
in more detail at the hearing, this grievance is denied.
Dated at Toronto this 3rd day of February 1977.
