At the request of the parties, the Board orders that the grievance
filed by 14s. Lightbody be fully and finally disposed of in the manner
agreed to by tne parties. That agreement is reproduced in full below,
on the express understanding that ic was entered into by the Employer
without prejudice to its position that the matter ,is not arbitrable.
To foster improved working ~relationships between
Hazel J. Lightbody (hereinafter referred to as the
griever), and her superiors at the Ministry of
Correctional Services (hereinafter referred to as
the employer) the parties agree as follows:
1. The employer will provide written
acknowledgement that actions ,takeen by the griever
in connection with the setting of an appointment
for w. Schaeffer was as,a direct result of
direction @ven by Wz. H. R. Hawkins.
2. The employer will provide acknowledgement that
actions taken by the griever in connection with the
Likeness/Tanner case were taken as a direct result
of directions given by ,Xary Gunn, and the griever’s
approach to the case was in accordance w?th the
Ninistry’s philqsophy of service to the public.
Similar case.s in future will be handled in
accordance with directions outlined in the memo of
19.5.82 from H. R. Hawkins to the griever, until
such time as there are changes in policy, at which
time the griever will be properly notified. :
3. The griever, in the presence of her union
representative will be ,allowed to read the
complaint of Iys. Taneja regardingan incident on
11.12.81.
4. The minutes of a meeting held on Hay 18,. 1982,
will be changed to reflect the attendance qf A.
Ayres and the absence of Dr. R. LeHerissier.
The employer agrees that the griever’s duties
and responsibilities at this time are as outlined
in her position. specification (1979), H. R. Hawkins
memos of 23.10.80 and 19.5.82 and in the minutes of
the May 18, 1982 meeting betxeen H. R. iiawkins,
A. J. Ayres and the griever.

officials will be conducted in accordance with the
memo of May 19, 1982, from H. R. Hawkins to
R. LeHerissier and H. Lightbody.
3. The employer acknowledges that the
responsibility for preparation of the vorkload
summary in December lYd1 did not rest with the
griever.
6. H, R. Hawkins will receive a copy of
J. Hannah’s memo of 17.8.82 addressed to griever.
7. Employer agrees that no action will be taken
against the griever for requesting this settlement. _
8. H. R. Hawkins agrees in principle with
R. LeHerissier’s memo of 19.5.82. The folloiYing
points are understood:
- Participatioxas a volunteer does not ensure
the griever’s placement or success in any
competition for Rehab Officer positions
which ray become available.
-Any activity as a volunteer will not
interfere with the griever’s carrying out of
her duties as an administrative clerk.
- Details of volunteer involvement and any
training to be provided will be discussed
and negotiated between the griever and bar
area uanager.
9. This agreement is made without prejudice to
the employer’s right to subsequently argue that the’
matters contained herein are not arbitrable.
10. The parties agree that this agreement fully
settles and completest. the grievance lodged by the
griever under date of 4.2.82, GSB File 114/82.

The Board hereby orders the matter resolved in
accordance with the above agreement.
