DECISION
This is a grievance dated October 19, 1984,'brought by'the
Ontario Public Service Employees Union, alleging that the Crown
in Right of Ontario (Ministry Of the Attorney General) .violated
Article 18 of the Collective Agreement betweenthese parties by
failing to make reasonable or adequate provisions for the safety
and health of certain employees who perform work at The Unified
Family Court for the Judicial District of Hamilton-Wentworth in
facilities located at 100 James Street South in the City of
Hamilton. Prior to the commencement of the hearing on March 7,
1985, Counsel informed us that discussions towards a possible
resolution of the grievance were taking place and requested that
for this reason, the hearing not commence for about one hour.
Some time later during the morning of March 7, 1985, Counsel
advised the Board that an agreement had been reached in
principle, the terms of which would be included in a Memorandum
of Settlement. We were requested to remain seized of the
grievance and consequent upon the execution of a Memorandum of
Settlement to incorporate the same into a decision of the Board.
In accordance with the wishes of the parties,. the Memorandum of
Settlement which has now been filed with the Board and is marked
as Appendix "A" herein, is made a part of the decision of the
Board, with the same force and effect as if its terms had been
ordered by The Grievance Settlement Board.
