DECISION
The Board convened on September 10, 1986. The griever did not attend.
His whereabouts are not known.
Counsel for the Union and the Union had made various attempts to contact
the griever and inform him of the proceedings in his case, but all to no avail.
On June 18, 1986, the Union wrote to the griever at his address where last
employed by the,Ministry, informing him of the arbitration hearing scheduled for
August 25, 1986.
There was a mediation meeting on July 10, 1986. Before this meeting,
Counsel for the Union called the griever’s last two known telephone numbers,
and was told at the last known number that the griever still lived there but
had not been seen for a few days. Counsel left a message for the griever.
The griever did not attend the mediation meeting.
After the mediation meeting, Counsel for the Union’called again and was told
the grieior had in fact moved out before July 10. So Counsel sent a registered
letter on July 18, 1986 to the last known’address, informing the griever that the
arbitration hearing was scheduled at the Grievance Settlement Board on August 25,
1986. The Registered letter was returned “unclaimed.” The hearing did not take
place that day for other reasons, but the griever did not know it was cancelled.
and did not attend.
Counsel for the Union made a last phone call to the list known number to
inform the griever of our hearing on September 10, 1986. Again Counsel was told
that the griever was no longer there.

Therefore the parties entered into the attached settlement which this Board
now endorses as its order to close this matter.

Without w precedent the parties agree that the
following terms constitute a fu\l and final settlement of the
above-captioned grievance..
(1) The Ministry agrees to pay to Mr. Hughes the' equivalent of
one-day's pay; and
(2) The Grievor agrees to withdraw
