INTERIM DECISION
The employer brought a Motion.at the conclusion of the
Union’s case to dismiss the grievancespursuant to the decision in
Faler and Ministry of Correctional Services G.S.B. 218/89 the
parties having stipulated to the Board that Faler is the agreed
applicable law.
The Board rules as follows:
1. There was no evidence adduced relating to the incident
of February 16, 1989 the only subject matter of the
grievance of David Dickinson dated February 2.4, 1989, and
accordingly that grievance is hereby ‘dismissed.
2. The balance of the Motion as it relates to the other
three grievances namely those’of Rate, Toombs and Kloss is
dismissed.
3. The hearing will continue on March 21, 1990.
