HomeMy WebLinkAbout1999-1723.Policy Grievance.00-05-08 Consent AwardONTARIOEMPLOYÉS DE LA COURONNE CROWN EMPLOYEESDE L’ONTARIO GRIEVANCECOMMISSION DE SETTLEMENTRÈGLEMENT BOARDDES GRIEFS 180 DUNDAS STREET WEST, SUITE 600, TORONTO ON M5G 1Z8TELEPHONE/TÉLEPHONE,(416) 326-1388 180, RUE DUNDAS OUEST BUREAU 600, TORONTO (ON) M5G IZ8FACSIMILE/TELECOPIE:(416) 326-1396 GSB # 1723/99 OPSEU # 00U002 IN THE MATTER OF AN ARBITRATION Under THE CROWN EMPLOYEES COLLECTIVE BARGAINING ACT Before THE GRIEVANCE SETTLEMENT BOARD BETWEEN Ontario Public Service Employees Union (Policy Grievance) Grievor - and - The Crown in Right of Ontario (Ministry of Health) Employer BEFORE Richard BrownVice Chair FOR THE David Wright GRIEVOR Counsel Ryder, Wright, Blair & Doyle Barristers & Solicitors FOR THE Len Hatzis EMPLOYER Counsel Legal Services Branch Management Board Secretariat HEARING May 2, 2000 At the hearing in this matter, the parties agreed to the issuance of a consent award incorporating the minutes of settlement set out below: Whereas the Union filed a letter dated March 7, 2000 alleging a breach of settlement dated February 2, 2000 between the parties, the parties agree on a without precedent and without prejudice basis to the following terms and conditions as settlement of the issues raised in the letter dated March 7, 2000: 1.Where an employee wishes to review his or her personnel file, they shall meet first with a Human Resources Assistant, or other human resources staff as authorized by the employer, in order to determine if there is agreement concerning the documents to be removed from their file, if any. 2.If there is a dispute between the employee and the Human Resources Assistant subsequent to the meeting referred to in paragraph one, and the employee requests, an appointment shall be scheduled between the employee and a Human Resources consultant who has the authority to determine the matter. 3.If an employee so requests, the employer agrees to remove the employee’s file documentation relating to union and discretionary leaves prior to transferring the said file to the new employer, and the employer agrees to discuss removing documentation relating to other types of leaves. 4.The union consents to the employer retaining the documents removed from the employee’s file pursuant to paragraph three in a file which it will maintain in its own possession. 5.The parties agree that Vice-Chair Brown will remain seized with respect to this settlement. 6.The parties agree to the GSB issuing a consent order incorporating the terms of this settlement.
