Union - and - The Crown in Right of Ontario (Ministry of Community Safety and Correctional Services) Employer BEFORE Loretta Mikus Vice-Chair FOR THE UNION Elizabeth Nurse Ryder Wright Blair & Holmes LLP Barristers and Solicitors FOR THE EMPLOYER Simon Heath Counsel Ministry of Government Services HEARING November 15, 2006. 2 Decision There are numerous grievances before me relating to a situation that has been occurring at the Don Jail since 2005. In an effort to expedite the hearing the parties have agreed to the following: Both parties agree that, given the nature of this case, the parties will be bound by the following conditions with respect to particulars and disclosure: 1. The particulars and/or disclosure will be treated confidentially and will be disclosed only on a “need to know” basis necessary to the preparation and litigation of the case. 2. There is to be no e-mail distribution of the particulars, the disclosure or of the threatening letters. Prior to sending any of these documents by facsimile, the sender is to ensure that counsel or their advisor will receive the facsimile personally. 3. All copies made of the particulars or disclosure will be retained in the control of counsel or their advisor. 4. Any person being provided with information contained in the particulars and/or disclosure will be advised of the confidentiality of the particulars/disclosure. 5. Issues arising regarding this Order, including any necessity for a variance of the Order, shall be dealt with in an expedited manner.
