Gage Counsel Liquor Control Board of Ontario HEARING November 14, 1996 ARBITRATION AWABR On the basis of the evidence presented and submissions of counsel, for reasons given orally at the hearing, it was concluded that the Employer had just cause to issue discipline against the grievor. However, under all the circumstances of the case, the discipline was excessive. The grievance is upheld, in part. The Employer is ordered to amend the record of employment by withdrawing the one-day suspension and substituting a disciplinary letter of warning on the record. Further, the grievor is to be compensated for the monies withheld. The Board retains jurisdiction with regard to implementation. DATED at Toronto, Ontario, this 20th day of November, 1996.
