In substance it alleges that the Employer is in contravention of Article 9 of the collective agreement by failing to make reasonable provisions for their health and safety. [2] A teleconference was held with regard to the issue of the disclosure to the parties herein, of a Crown disclosure brief for the prosecution of an individual for obstructing a provincial officer appointed under the Nutrient Management Act (“Crown Brief”). Mr. Nicholas Adamson, Crown Counsel, Ministry of Environment & Climate Change, who had carriage of the prosecution joined the teleconference. All parties were in agreement that the Crown brief would likely contain evidence relevant to the issues in dispute in the instant arbitration. [3] Mr. Adamson advised that while he did not object to the disclosure of the Crown brief, in light of the provisions of the Freedom of Information and Protection of Privacy Act, disclosure could only be made upon an order by the Board to do so. Mr. Adamson further requested that certain conditions be attached to any order made. Union and Employer counsel made no objection to the conditions sought. In the circumstances the Board orders as follows. [4] ORDER WHEREAS the Ministry of the Environment and Climate Change (“MOECC”) conducted a prosecution of Vincent Nelson Amlin for obstructing or hindering Janice Pechinger in the performance of her duties as a provincial officer appointed under the Nutrient Management Act, 2002. AND WHEREAS Mr. Amlin was convicted and sentenced for the offence on December 20, 2013; AND WHEREAS Mr. Amlin did not appeal the conviction and sentence; AND WHEREAS the Board is satisfied that the Crown brief is likely to contain evidence relevant to the instant arbitration; - 3 - The Board orders as follows: 1. MOECC Crown counsel with carriage of the Prosecution shall produce all documents contained in the Crown brief to counsel for the parties to this arbitration. 2. The parties to this arbitration and their counsel shall use and/or make copies of the disclosure materials only for purposes related to this arbitration. 3. The disclosure materials shall not be disclosed to anyone other than the parties to the arbitration, their counsel and the Grievance Settlement Board. Anyone receiving access to the Crown brief pursuant to this order shall use and/or make copies of the disclosure material only for purposes related to this arbitration, and shall not otherwise disclosure the contents thereof to anyone. 4. MOECC will produce only documents in its possession and control, and nothing in this Order shall require MOECC to search for or obtain documents from any other agency or person. 5. Before producing the Crown brief, MOECC Crown counsel will redact the documents in the disclosure brief to remove reference to personal information of third parties that is irrelevant to the instant arbitration.
