The Employer is seeking release of the May 16, 2011 Independent Medical Examination Report as well as the Grievor’s Long Term Insurance Plan (LTIP) file. The Union is directed to provide a copy of these documents to counsel for the Employer, or at least the opportunity to review (and photocopy) them. [2] To protect the Grievor’s privacy, these documents may only be used in connection with this litigation, and may be shown only to the following: counsel, the Injury & Wellness Advisor, two advising clients (and their direct superiors), and the Human Resources Advisor. These individuals may not otherwise disclose or discuss the content of these medical records, nor may any copies (other than the one for counsel) be made, except in connection with the hearing (i.e., if a document is tendered as an exhibit at the hearing).
