Williamson Vice-Chair FOR THE UNION Jane Letton Ryder Wright Blair & Holmes LLP Counsel FOR THE EMPLOYER Roslyn Baichoo Treasury Board Secretariat Legal Services Branch Counsel CONFERENCE CALL April 24, 2015 - 2 - Decision [1] A hearing was held on November 19, 2014 in relation to the grievances of Ms. Tanya Warner numbered 2014-0286, 2014-0287, and 2014-3149. Following mediation on that date the grievances remained unresolved and the date of May 5, 2015 was agreed upon, with the input of the grievor, for these grievances to be heard at arbitration. [2] On April 24, 2015 a telephone conference call took place between counsel for the parties and the undersigned Vice-Chair. At that time, Counsel for the union made the request to the Board for an adjournment of the May 5, 2015 arbitration hearing date on account of the grievor needing to travel to be with an ill relative and thus not being able to attend the hearing. Additional information had not been provided by the grievor. [3] Counsel for the employer advised that it was opposing the request to have the May 5, 2015 arbitration adjourned to a later date in that the hearing date had been set with the input of the grievor and that no particulars had been provided by the grievor of this need for travel which would result in her not being able to attend the arbitration hearing on May 5, 2015. [4] Having heard the foregoing submissions of the parties, Ms. Warner is hereby directed to provide Counsel for the union with the following particulars by no later than 4:00 p.m. on Thursday, April 30, 2015: (a) The relationship of the ill relative to Ms. Tanya Warner. (b) The town and country in which this ill relative is living. (c) The nature of the illness or condition of this ill relative that requires Ms. Warner’s travel. (d) The expected duration of Ms. Warner’s travel. (e) Whether any travel arrangements have yet been made by Ms. Warner and, if so, Ms. Warner is to provide full details of her travel plans and travel documents.
