Klym~ Member . ~.~Mo nt~ro ~~ e~~ M~~e ~e~ ~ ' MEMORANDUM OF SETTLEMENT between THE MINISTRY OF COMMUNITY AND SOCIAL SERVICES and THE ONTARIO PUBLIC SERVICE EMPLOYEES UNION RE: Irene Sabo GSB#: 645/88 Without prejudice and without precedent, the parties agree to the following terms as full and final resolution of the above-captioned grievance and any and all related matters: 1. The grievor will ~e placed on the surplus list as an OAG12 pursuant to Article 24 of the Collective agreement for a period of six (6) months. The parties agree that placement on the'surplus list shall be governed solely by' the following articles of the Collective Agreement signed on September 5th; 1990 in effect to December 31, 1991: Articles 24.2.1, 24.2.2, 24.2.3, 24.2.4 and 24.3. Placement on the list will take place as soon as posDible but no later than June 1, 1992. 2. In th'e event that the grievor is not placed during the six months while on the surplus list, the grievor will be r~moved from the surplus list, all entitlements to job referrals will cease and the Ministry will be deemed to have met i~s 0bligat~ons under the settlement. 3. Should the grievor not attend a placement interview or accept an assignment offered in accordance with the articles referenced in paragraph one, she shall be removed from the surplus list,' all entitlements.to job referrals, will cease and the Ministry will be deemed ~o have met its obligations under the settlement. 4. For the purposes of being considered for vacancies under Article 24, the grievor's seniority will be adjusted to December 18, 1977 in order to account for the period time during which she has been separated from the Ontario Public Service. As the grievor's original seniority date was March 1'8, 1974, the adjusted senority date will be 45 months later, which is December 18, 1977, based on a June 1, 1992 placement date on the surplus list. 5. For the purposes of being considered for vacancies under Article 24, the grievor's "headquarters" will be deemed to be 2195 Yonge Street, Toronto. 6. In the event the grievor is reappointed, under the terms of this settlement, it is understood that amounts received under the Voluntary Exit Option will be subject to repayment. pg 1 of 2 pg 2 of 2 7. Arrangements for repayment of amounts identified in paragraphs 6 shall be mutually agreed to prior to reappointment with the condition that repayment be completed within two years from date of reappointment. 8. The parties agree.that should the grievor be reappointed to the Ontario Public Service under the terms of this settlement, she shall be deemed to be appointed to the regular staff with no requirement for a probationary period. 9. The parties'agree that should the grievor be reappointed to the Ontario Public Service under the terms of this settlement, her continuous service date will be established in accordance with Article 25.1 of the Collective Agreement. 10. The parties agre~ that this .settlement be made an order of the Grievance Settlement Board. 11. The union and the grievor agree to withdraw the grievance.
