Smeaton Manager Staff Relations Human Resources Branch Ministry 'of Transportation Hearing: May 25, 1989 DECISION The parties have consented to the following Board order: Job competition MT-88-115 Senior Research Technician (Pavements and Roadway Research Office) shall be re-mn on the following conditions: a) The competition will not be re-posted; b) The Ministry shall establish a new selection panel, with no members from the original selection panel; c) The new selection panel will only interview Roy Rigglesworth and Jerry Pieters for the position; d) The incumbent cannot rely on any knowledge or experience that he has gained in this position as a result of being awarded the position in the original competition. The new selection panel will operate on the basis of each candidate's qualifications, ability, experience, and knowledge as of the date of the interviews in the original competition; · e) The new selection panel will develop procedures it considers appropriate within the parameters of Article 4.3 of the Collective Agreement; f) The same selection criteria used in the original competition will be used in the re-mn. The selection criteria to be used are those listed as qualifications in the original job posting, but only those that pertain to the Pavement Technician position; g) The new written and oral questions asked, shall accurately reflect, and shall correspond to the relative weights of, the selection criteria, the content of the position specification and the particular requirements of the job. The new questions devised shall be worded such that they will extract sufficient information to enable a judgment concerning the candidates' possession of the selection criteria; -2- h) The new selection panel will review the personnel file of the internal candidate, but only with regard to qualifications and ability as of the date of the original competition; i) To the extent possible, given that one candidate is from outside the Ministry, the new selection panel will consult with at least one supervisor familiar with the work of each candidate, but only with regard to qualifications and ability as of the date of the original competition. With regard to the outside candidate, any supervisor presently employed by the Ministry is excluded from having any input; j) In the event that the grievor is successful in the re-mn of the original competition, he shall be compensated for any loss in wages and benefits occurring as a result of his being unsuccessful in the original competition, retroactive to the date the incumbent originally filled the position.
