Uhlmann staff Relations officer Ministry of the Attorney General BOARD ORDER Attached hereto is a executed Memorandum of Settlement which the parties agreed would be made an order of the Board. Roberts, Member MEMORANDUM OF SETTLEMENT In the matter of the Crown Employees Collective Bargaining Act and in the matter of a Grievance Between: Ontario Public Service Union, Local 520 union and - The Crown in Right of Ontario (Ministry of the Attorney General) Employer - and - Vivienne Subraj Grievor RE: Competition AG2400B/88 GSB file #328/89 Without prejudice and without precedent, the parties hereto agree to the following terms as full and final settlement of the captioned grievance. 1. The Employer agrees that in the above-noted matter it did not follow the provisions of the Collective Agreement between the Management Board of Cabinet and the Union, specifically as defined under Article 4. 2. The Employer agrees to place the grievor in the position which was the subject of Competition No. AG2400B effective as of April 24, 1989, and further agrees that the grievor shall assume the responsibilities of the said position as of the date of this Memorandum of Settlement being deemed an Order (reference clause #5). 3. The Employer agrees to pay to the grievor the differential in salary between the position which was the subject of Competition No. AG2400B and the grievor's salary, for the period between April 24, 1989 and the date of the grievor's assumption of responsibilities in the said position. 4. The Employer agrees that no references or comments therein with respect to the grievor which were obtained for the purpose of the comDetition in question shall appear on the grievor's personnel file. 5. The parties agree that this settlement shall be made an Order of the Grievance Settlement Board. 6. The Union and the Grievor agree to withdraw the captioned grievance.
