Montrose, Member ~.B.B. #s377/ag MEMOi~DUM OF BETTLEMENT Between: The Crown in Right of Ontario (Ministry of Transportation) The Employer - and - Ontario Public Bervice Employees Union' The Union - and - Arthur J. Cassell, and Edwin W. Laugher The Grieyors Without Prejudice and Without Precedent, the Employer and the Union agree to the following, as a full and final settlement of the Grievers' grievances, dated September 8, 1989. 1. The Employer shall hold a new competition for the position of Highway Carrier Inspector III, in Ottawa West, to satisfy the Grievers' grievances against competition ER/89/48. 2. The position of Highway Inspector III, in Ottawa West, shall not be designated as bilingual, for the purposes of the competition. .. 3. The applicants eligible to participate in the new competition shall be restricted to the two Grievers and the successful applicant in competition ER/89/48. 4. The panel for the new competition shall not have any member forming part of the panel for competition ER/89/48. 5. The Union and Grievers shall withdraw the grievances. 6. The Union shall advise the Grievance Settlement Board the grievances are withdrawn. 7. Either party to this agreement may have this Memorandum made an order of the Grievance Settlement Board.
