( Fraser & Beatty Barristers & Solicitors HEARING: November 6, 1990 '" ~ ..... <'. 2 At the commencement of the hearing in this matter, the Board , was informed that the parties had . reached a settlement on the differences between them but requested the Board to issue a consent order incorporating the terms of the settlement. The terms of the settlement are attached to the decision herewith and become part of the award. Paragraphs 3 and 5 of the Agreed Terms of Settlement incorporate: terms with respect to the Grievance Settlement Board remaining seized with respect to issues of retroactivity, compensation' and interest, as well as retaining jurisdiction in respect of the implementation of this order. The Board agrees to these terrn~ and will await further developments and should either Party inform the Board that it is unable to resolve the issues of retroactivity, compensation and interest, the Board will reconvene to hear the Parties in that respect. THE CROWN IN RIGHT OF ONTARIO (Ministry of ~ Labour) (Employer) OFtDER I I WHEREAS the Grievors MS.Kent and Ms. Pauker filed classification grievances dated February 21) 1990 and Ms. Clarke filed a classification grievance dated April 3, 1990, the parties and the grievors have agreed, without prejudice and without precedent, to a full and final resolution of the grievances and have consented to an order of the Grievance Settlement Board in the following terms: 1. The Employer will reclassify the grievors into a new and appropriate classification once a new class standard has been prepared in accordance with I paragraph 2 below. :;;; I .....' 2 2. The Employer will prepare a class standard for the new classification within four months of the date of this order and a salary rate will then be determined in accordance with Article 5.8 of the Collective Agreement. 3. The Grievance Settlement Board will remain seized with respect to the issues of retroactivity, compensation prior to the effective date of the new standard, and interest. 4.
