HEARING: March 4, 1991
DECISION
At the heàring in this matter the parties entered into a
memorandum of agreement. The terms of this memorandum of
agreement provide as follows:
Without prejudice and without precedent, the Employer,
the Union and the Grievor agree to the following, as
a full and final settlement of the Grievor1s grievance
90C195 over accrual of vacation credits, dated May 1,
1990
1. The Employer shall pay the grievor the sum
of seven thousand four hundred and twelve
dollars and thirty-two cents ($7,412.32) with
interest calculated in accordance with the
Courts of Justice Act as set out in Appendix
uA"; such sum shall be subject to the usual
statutory deductions;
2. The Employe~ shall deposit $8000.00 of the monies
owing to the Grievor into an R.R.S.P. account to
be opened by the Grievor; the rest to be paid
directly to the Grievor by March 31, 1991;
3. The Union and the Grievor shall withdraw the
Grievor's grievance 90C195 and shall notify the
Grievance Settlement Board that the grievance is
withdrawn;
4. Either pa,rty to this agreement may have this
Memorandum made an order of the Grievance Settlement
Board;
5. Any breach of this agreement may be processed through
the Grievance Settlement Board.
