Dorland HEARING: January 24, 1991 (e te y ~~ ~ DECISION Whereas the Employer, the Union, and the Grievor have agreed, without prejudice and without precedent to any position the parties may take in respect of the interpretation, application or administration of " the collective ag!eement in any other matter between them, to a full and final resolution of the grievances of the grievor dated March 23, 1990 and April 6, 1990 and have consented to an order of the Grievance Settlement Board on the terms set out belo)!, this Board orders as follows: 1 . The grievor be appointed to the position of Shift Supervisor (Ambulance Officer 4 Classification) in the Peel-York and District Ambulance Service replacing Mr. Chris Dorland (Mr. Dorland is a bargaining unit member who was duly notified of these proceedings and attended and made submissions to the Board). The grievor's appointment is to be retroactive to April 2, 1990 and the grievor is to receive compensation for all lost pay and benefits, including interest, and his appointment is to be on the same terms and conditions as the o~her appointments in Competition No. HL-73-07. 2. The Board hereby declares that the grievorts qualifications and ability to perform the required duties of the positions posted in Competition No. HL-73-07 are :e' 'e ,þ"/' ..~ 2 relatively equal with those of Mr. Chris Dorland and Mr. Brad Meekin (Mr. Meekin is a bargaining unit employee who was duly notified of these proceedings and his rights with respect thereto and chose not to attend). 3. Upon completion of paragraph 1 above, these grievances are withdrawn. 4. The Board will remain seized with respect to the implementation of this order. .... 5. Mr. Dorland will be returned to his position as an Ambulance Officer 2 with Peel-York and District Ambulance Service upon Mr. House assuming his duties as an Ambulance Officer 4 (which shall take place no later than February 4, 1991) .
