IN THE MATTER OF A GRIEVANCE
BEFORE THE
GRIEVANCE SETTLEMENT BOARD
BETWEEN:
ONTARIO PUBLIC SERVICE EMPLOYEES UNION
(David Clayton - grievor)
AND
THE CROWN IN RIGHT OF ONTARIO
MINISTRY OF TRANSPORTATION
(Employer)
RE: GSB # 1840/91
In full and final settlement of the above captioned grievance,
dated October .3, ~1991, the parties agree without prejudice or
___precedent to ~esQlve the matter on the following' terms: . "
1. The Employer shall create a new class Standard which
accurately reflects the duties and responsibilities of
the Grievor within one hundred and twenty days-of--the ---
execution of the Memorandum of Settlement.'
2. The rate of pay in respect to the new classification
shall be determined in accordance with the Collective
Agreement.
3. The grievor shall be reclassified to the classification
referred-to in paragraph #1 (above) effective twenty
working days prior to October 3, 1991.
4. Should any payment be made to the grievor in respect of
retroactive wages pursuant to paragraph #1 (above) such
payments shall bear interest calculated in accordance
with the formula as set out in the Hallowell Ho~se case.
5. The parties agree that this settlement shall be made an
order of the Grievance Settlement Board.

6. The Grievance Settlement Board shall retain jurisdiction
with respect to the implementation of this award.
7. Upon fulfilment of the above terms of settlement, the
grievance is withdrawn.
