Gallop EMPLOYER Counsel Winkler, Filion & Wakely Barristers & Solicitors HEARING June 12, 1992 2 ORDER Robert Proudlove is a maintenance electrician with the Ministry at Thunder Bay. On July 25, 1992 he received a three day suspension for alleged improper conduct on the job. In a grievance filed, he alleges improper discipline, G.S.B. %2368/91. Subse'quently on December 20, 1992, Mr. Proudlove was dismissed for alleged improper behaviour and performance in the workplace and in particular alleged improper behaviour towards a co-worker. In a grievance dated Decemb~? 23, 1992, he alleges unjust dismissal, G.S.B, %2663/91. The-suspension grievance came on for hearing at Toronto on June 12, 19.92 at which time the parties sought- an order for procedural directions. After hearing full submissions, the panel made the following order: (1) Upon consent of the parties, the suspension grievance, G.S.B. %2368/91, and the dismissal grievance, G.S.B. #2663/91, will be heard together before this panel. (2) The hearings shall take place at Thunder Bay on October' 21, 22, 23, 28, 29, 30 and November 2, 3, 4 and 5, 1992. (3) The Ministry shall pay reasonable costs and disbursements to the Union for its preparation to meet the Ministry's preliminary' 3 objection to jurisdiction, with the panel to remain seized in the event that the parties fail to agree on the appropriate quantum of compensation. (4) The Ministry shall provide to the Union full particulars of the allegations it intends to rely upon in support of the letter of suspension dated july 25, 1991, and full particulars of the allegations against the grievor which lead to the dismissal. (5) The Ministry shall produce all documentation obtained in the course of its decision to suspend and dismiss the grievor.
