MEMORANDUM OF SETTLEMENT I~N THE MATTER OF A GRIEVANCE BEFORE THE GRIEVANCE SETTLEMENT BOARD BETWEEN: ONTARIO PUBLIC SERVICE EMPLOYEES UNION (and thirteen grievors) David McAvoy Kevin Ogilvie Paul .Moore GSB No.3095/91. AND THE CROWN IN RIGHT OF ONTARIO MINISTRY OF TRANSPORTATION (Employer) In full and final settlement of the thirteen classification grievances listed above; the parties agree without prejudice or precedent to resolve the matter on the following terms: 1. The Employer shall create a new class standard which will accurately reflect the duties and responsibilities of the individual Grievors. 2. The Employer shall create the new class standard within one hundred and eighty days of the date of receipt the Union's execution of the Memorandum of Settlement. 3. The rate of pay in respect to the new classifications shall be determined in accordance with the Collective Agreement. MEMORANDUM OF SETTLEMENT ONTARIO PUBLIC SERVICE EMPLOYEES UNION (and thirteen grievors) AND MINISTRY OF TRANSPORTATION 4. The grievors shall be reclassified to the classification referred to in paragraph #1 (above) effective October 1, 1990. 5. Should any payment be made to the griev°rs in respect of retroactive wages pursuant to paragraph #1 (above) such payments shall bear interest calculated in accordance with the formula as set out in the Hallowell House case. 6. The parties agree that this settlement shall be made .an order of the Grievance settlement Board. 7. The Grievance Settlement Board shall retain jurisdiction with respect to the implementation of this award. 8. Upon fulfilment of the above terms of settlement, the grievances are withdrawn.
